Terms & Conditions of Sale

A binding contract is created between Party’s in the bag and the buyer when the buyer receives communication from Party’s in the bag in writing confirming acceptance of their order. The buyer accepts Party’s in the bag terms and conditions.

Health & Safety
All toys supplied by Party’s in the bag comply with the European Toy Safety Regulations and bear the CE mark. An adult must supervise the use of any product at all times. The buyer is responsible for ensuring that all statutory government or local authority regulations are complied with in relation to the use of any products purchased from Party’s in the bag

The price of products confirmed at the point of purchase will remain fixed during the transaction.

All prices quoted on the site are subject to alteration without notice to take account of fluctuations in the cost of labour and materials and of alterations in rates of exchange and import duty that may occur in the course of manufacturing the products.

Party’s in the bag shall be entitled to adjust the price to take account of any alteration made by the buyer to the specifications or other information supplied by the buyer.

Copyright and Trade Marks
The copyright in any design, presentation, packaging and/or literature in connection with the products shall remain the property of the owner of that copyright and no right or licence (except as to the use for which the products are supplied) shall be granted hereby whether express or implied.

All images, logos, trademarks are the property of Party’s in the bag and may not be reproduced, copied, or otherwise manipulated without our express permission in writing.  Party’s in the bag, Party’s in the bag and any other form describing our business are Registered Trade Marks belonging to Party’s in the bag

Party’s in the bag makes no warranty in respect of any products or service advertised by Party’s in the bag on this website but which is supplied by a supplier independent to Party’s in the bag

The full price for ordered products must be paid prior to despatch. All orders must be paid for in Pounds Sterling, and in the case of payment by cheque, drawn on a bank account located within the United Kingdom.

Where prices are displayed in currencies other than UK Pounds these will be converted into UK Pounds at the time of the transaction. The rate applied is controlled by the customer’s credit card company and not Party’s in the bag

In the event of a failure by the buyer to pay for the product without good cause, Party’s in the bag reserves the right to take action in order to recover the value of these goods and reasonable expenses.

Any such products or part of products so re-possessed may be re-sold without notice to the buyer and without prejudice to our right to claim damages against the buyer for any losses or expenses incurred, save that the proceeds of such sale shall be set off against any sums due from the buyer in respect of the products.

Party’s in the bag reserve the right at any time to charge interest on late payments with effect from the due date and on a day-to-day basis at a compound annual rate of 4% above Lloyds TSB plc base lending rate from time to time.

In the event that the buyer fails to make payment for the products or fails to take delivery of any of the products supplied by us, then all sums outstanding in respect of any products supplied by Party’s in the bag shall if not already paid in full become due and payable immediately. Party’s in the bag may at its absolute discretion and without prejudice to any other rights suspend all future deliveries of the products to the buyer under the contract in question and/or terminate any such contract(s) without liability upon our part. Failure to pay the balance outstanding will entitle Party’s in the bag to charge interest on the balance outstanding at the rate of 4% interest above Lloyds TSB Plc base rate.

Party’s in the bag will ensure that your order and any payment information you provide is kept private and confidential. Party’s in the bag will not retain any customer information beyond that necessary to confirm your order, despatch the products and trace the delivery. Party’s in the bag does not supply customer information to third parties other than as specifically stated herein (i.e. to enable the carrier to deliver the products).

Where the buyer is using the online payment method, Party’s in the bag uses a recognised online credit payment agency that has secure server software encryption to keep your transaction private and protected. Paying by this method will require the buyer to visit another website. Party’s in the bag accepts no responsibility and shall not be liable for errors or omissions on the part of the credit payment agency that results in the disclosure of confidential information, loss, expense or damage howsoever arising to the buyer. It is the responsibility of the buyer to read the terms of business of the credit payment agency before using the service.

Delivery and Risk in the Product
Delivery within the UK will normally be made within 1 to 2 working days of despatch. Party’s  in the bag will normally despatch an order within 1 working day of the order being confirmed and payment being received.

Delivery charge rates will vary from time to time, however we will try to notify you as necessary.

Party’s in the bag shall not be liable for delay or failure to deliver products promptly if such failure arises due to force majeure or by reason of any delays occasioned by strikes, riots, lockouts or other labour trouble, war, fire, accident, mechanical failure, non-availability to Party’s in the bag of manufactured stock, parts, or materials; delay or failure of delivery of the products to Party’s in the bag by manufacturers suppliers or other persons; government action, legislation or regulation of any kind; Act of God, or any circumstances whatsoever outside our reasonable control.


If you provide us with a 'leave safe' instruction your parcel is deemed to have been delivered and the contract completed when the delivery agent follows your instructions.  The risk transfer to you upon that event.


Loss or Damage in Transit
Whilst every effort is made to deliver your goods on time we cannot take responsibility for delays or damage in transit. Time is not the essence of the contract. Party's in the bag’ responsibility for loss or damage in transit will be limited to replacing the damaged products or providing a refund, whichever the buyer prefers.

You may return your goods for a full refund (less the cost of delivery) at any time up to 10 working days after you have received your parcel. The goods must be received by us in the same condition as they were sent with any packaging undamaged so that they remain in a saleable condition. We cannot accept the return of any foil-wrapped chocolates or non-packaged sweets. If we advise you that the goods you wish to purchase have to be obtained by us as a 'special order' these cannot be accepted for return except if they are in any way faulty. Please ensure that you package the items safely and you retain proof of posting. A refund will be issued crediting you using the same method that you used to pay for the goods originally.

If you are not completely satisfied with your purchase, for whatever reason, we guarantee to exchange or provide a full refund upon the return of the goods. The customer will need to bear the cost of returning the goods to us. If Party’s in the bag is at fault the postage costs will be refunded.

We will endeavour to respond to and resolve all complaints within 2 working days.

This does not affect your statutory rights as a consumer.

Governing Law

English Law shall govern the construction, validity and performance of these Conditions of Sale and of any agreement that exists between Party’s in the bag and the buyer in all respects. In any dispute with Party’s in the bag regarding these Conditions of Sale or the supply of products to the buyer, the parties shall submit to the jurisdiction of the English Courts.
